Do I Need a Will?
Many people put off writing a Will: Some believe that a Will is not necessary. Others view the process as being overwhelming because important decisions (about assets and family) must be made. Whilst many are simply too busy and do not have the time.
A Will is a legally binding document and protects the people you love.
A well drafted Will ensures that your Estate (your possessions, property and money) is distributed according to your wishes. If you do not have a Will, the law controls who should “benefit.”
Importantly, a Will can also cover who will become the legal guardians of your children, the type of funeral you would like, charity donations, or even who you would like a specific possession to go to.
What should I include in a Will?
The team at Bassets will talk you through all the items you need to consider when writing your Will. A Will gives you peace of mind by protecting your family and loved ones for the future. Things to consider putting into your Will include:
- Who you would like to benefit from your estate.
- If you would like any possessions (i.e. jewellery) to go to a particular person.
- Who you would like to be an executor of your Will. These are the people that look after the process after your death.
- Who will look after and become the legal guardian of any dependent children.
- If you would like to include any specific information regarding your funeral.
- If you have any charities, you would like to make a donation too.
Dead of Variation (Change to a Will)
People often make a Will and forget about it. You should update your Will to reflect any changes in in your personal circumstances or if you simply change your mind. Circumstances include marriage, civil partnership, divorce, children, a death of a beneficiary or executor.
If you do not update or change your Will, the existing Will governs how your Estate is administered. As a result, you might leave out the loved ones and family members you intended to provide for. Someone therefore may go on to contest the Will.
